The Will of Henry Augustus LUCKETT 1897
THIS IS THE LAST WILL AND TESTAMENT of me HENRY AUGUSTUS LUCKETT of THIS IS THE LAST WILL AND TESTAMENT of me HENRY AUGUSTUS LUCKETT of Calne Wilts Gentleman I hereby revoke all former wills and testamentary dispositions at any time made by me I hereby appoint Noah Webb of Calne Wilts retired Chemist and Charles Herbert Barton of Calne Wilts Commercial Clerk hereinafter called my said trustees to be EXECUTORS and TRUSTEES of this my will I give devise and bequeath all my real and personal estate and property of whatsoever tenure or description the same may be and wheresoever situate unto my said trustees Upon trust with all convenient speed to sell get in and convert the whole into ready money and having paid the cost of so doing and my just debts and funeral and testamentary expenses and the estate duty to pay thereout the following legacies to my sister Ellen the wife of Levi Butler a legacy of two hundred pounds to the said Levi Butler a legacy of one hundred pounds To George and Sarah children of my said sister Ellen Butler a legacy of one hundred pounds each To such of the children of my late brother George Luckett as are now living as shall survive me a legacy of twenty pounds each To such of the children of my late sister Sarah Poole (Moreton-in-Marsh) as are now living as shall survive me a legacy of thirty pounds each To such of the children of my late sister Mary Ann Andrews as are now living as shall survive me a legacy of thirty pounds each To the widow of my late wifes brother Samuel Howard a legacy of fifty pounds To Fanny wife of Thomas Goddard ( daughter of the said Samuel Howard) a legacy of two hundred and fifty pounds to such of the other children of the said Samuel Howard as are now living as shall survive me a legacy of fifty pounds each To such of the children of my late wifes brother Edward Howard as are now living as shall survive me a legacy of fifty pounds each To my late wifes sister Elizabeth Cranmer a legacy of fifty pounds To Joseph Howard Gant son of my late wifes sister Fanny Gant a legacy of thirty pounds To my friend the said Noah Webb a legacy of eighty pounds To my late business assistant John Bridges a legacy of twenty pounds To my present housekeeper Ann Cotton a legacy of fourty pounds To each of my said trustees Noah Webb and Charles Herbert Barton a legacy of ten pounds upon condition that they each undertake the trust of this my will (as to the said Noah Webb in addition to the legacy hereinbefore given in his favour) To the Vicar and Churchwardens for the time being of the Parish of Calne a sum of one hundred pounds which shall be held by them or other the Vicar and Churchwardens for the time being of the said Parish and be by them invested and the annual income of which they shall from time to time annually at Christmas pay to or apply in such manner as to them shall seem best for the benefit of the women for the time being inhabiting the Almshouses situate in Kingsbury Street in the Borough of Calne and I give all the aforementioned legacies free of legacy duty and I direct my said trustees to pay the said duty out of my residuary trust monies and as to all my residuary trust monies remaining subject to the payment thereout of all expenses whatever incurred by my said trustees in winding up and distributing my estate or in relation thereto to pay and divide the same (with any legacies which may lapse under this my will) unto and equally between such of the children of my said late sister Mary Ann Andrews and the children of my said late sister Sarah Poole as are now living as shall survive me the said Joseph Howard Gant the said Noah Webb and the said Ann Cotton (in addition to any legacies already bequeathed to either of them) share and share alike for their absolute use Provided and I hereby direct as to the legacies given to the said Ellen Butler and Levi Butler that if either of them shall predecease me leaving the other surviving me then the one surviving me shall also take the legacy of the other predeceasing me and as to the legacy given to the said Fanny Goddard that if she shall predecease me leaving her present husband Thomas Goddard surviving me then he shall take the legacy bequeathed to the said Fanny Goddard and further provided that subject as last aforesaid if any child of the said Ellen Butler George Luckett Sarah Poole Mary Ann Andrews Samuel Howard (including the said Fanny Goddard) or Edward Howard who would if leaving at the time of my death take under this my will shall be then dead leaving a child or children who shall survive me or if the said Elizabeth Cranmer Joseph Howard Gant Noah Webb John Bridges or Ann Cotton shall predecease me leaving a child or children who shall survive me then and in every such case the child or children of him or her so dying shall take if more than one equally between them the share which his her or there parent would have taken under this my will if such parent had survived me IN WITNESS whereof I have hereunto set my hand the ninth day of October one thousand eight hundred and ninteysix - HENRY AUGUSTUS LUCKETT - SIGNED and acknowledged by the said Henry Augustus Luckett as and for his last will and testament in the presence of us both being present at the same time who at his request in his presence and in the presence of each other have On the 12th day of January 1897 Probate of this will was granted to Noah Webb and Charles Herbert Barton the Executors.
