1843 - The Will of Daniel Sly of Chedworth

This is the last Will and Testament of me Daniel SLY of the Parish of Chedworth in the County of Glouceter which I do make and ordain in manner and form following.
First I order and direct all my just debts and funeral and testamonley expenses may be fully paid and satisfied as soon as may be after my decease and I hereby charge and make liable my real as well as my personal estate with the payment thereof.
Then I give and bequeath unto my beloved wife Elizabeth SLY all my Freehold Cottage House Garden Orchard Ground and Premises I lately purchased of Giles COATES Also an Inclosure of arable land near Smuggs Barn in the Parish of Chedworth all now in my own occupation containing about six acres and a quarter be the same more or less together with my Freehold Cottage House and garden situate in Queen Street in the said Parish of Chedworth now in the occupation of Paul TAYLOR. As also all my stock money goods and chattels of what kind or nature soever I give unto her own will and disposal forever.
Lastly I nominate constitute and appoint my wife Elizabeth my whole and sole Executrix of this my last will and testament whom I also charge with the payment of all my just debts funeral and testamentry expenses out of my said property and I hereby revoke and disclaim all and every other former will or wills by me in any ways before named ratifying and confirming this and no other to be my last will and testament in witness whereof I have hereunto set my hand and seal this twenty second day of February 1843.

Daniel SLY died at the age of 80 on 13 March 1845 and was buried at St. Andrews Church, Chedworth on 18 March 1845, the above will was sworn to be valued under £200. Elizabeth SLY died at the age of 72 on 8 January and was buried on 13 January 1847 in Chedworth.
In 1843 (Tithe Map) Daniel SLY owned:
449 - House and Garden "Old Prices" and 448 the orchard behind it.
475 - Cottage "Mile End" occupied by Paul TAYLOR (just north of the 7 Tuns)
445 - Smuggs Barn Piece - now the playing field next to the Village Hall
447 - The Field (which is west of the playing field).

1845 - The Will of Elizabeth Sly of Chedworth

This is the last Will and Testament of me Elizabeth SLY of the Parish of Chedworth in the County of Glouceter Widow which I do make and ordain in manner and form following.
First I order and direct that all my just debts funeral and testamentry expenses may be fully paid as satisfied as soon as may be after my decease and I hereby charge and make liable my real as well as my personal estate with the payment thereof.
Then I give devise and bequeath unto my friend William BIRKIN of Chedworth all my freehold cottage house and garden situate in Queen Street together with all my household furniture goods and chattels of what kind or nature soever ready money debts and securities for money whatsoever and all my estate and effects both real and personal to which I or any person or persons or entitled to. To hold the same unto the said William BIRKIN his executors and administrators. Upon trust herein after expressed That is to say upon trust that my said trustee his executors and administrators shall have full power to sell execute and administrators shall have full power to sell execute and convey my aforesaid cottage house and garden and convert the same into money and all the neat proceeds arising from such sale I give and bequeath unto Phoebe PRITCHARD one third part thereof, to Elizabeth PEACHEY wife of William PEACHEY one third part thereof and unto Mary FRY daughter of William FRY one third part thereof together with my bed bedstead and brown furniture with pillows blanketts and sheets thereto belonging in the far room to them their heirs and assigns forever the same to be paid to them by my said trustee within six months next after my decease.
Then all the residue and remainder of all my household furniture goods and chattels of what kind or nature soever together with all my mony now in my possession and all money on securities at interest or otherwise to which I or any person in trust for me shall at my decease be seized possessed or entitled to. I give and bequeath unto my sister in law Mary FINCH and my sister in law Sarah SLY in equal shares and portions share and share alike to them their heirs and assigns forever the same to be paid to them by my said trustee within six months next after my decease. And I hereby order and direct that my said trustee for the time being shall and may out of the monies that shall come into his hands by virtue of the trusts aforesaid retain to and reimburse himself all such costs charges and expenses as he shall sustain expend disburse or be put unto in or about the execution of the trusts hereby in him reposed or in any way wise relating thereto.
And I hereby appoint the said William BIRKIN my whole and sole executor in trust of this my will hereby revoking all former wills by me at any time heretofore made and declaring this only to be my last will and testament in witness whereof I have to this my last will and testament set my hand this fourth day of December in the year of our Lord one thousand eight hundred and forty five.

1852 - The Will of Mary Sutton, Widow of Chedworth

This is the last will and testament of me Mary SUTTON of Chedworth in the County of Gloucester widow. In the first place I will and direct that all my just debts (including a debt of three hundred and thirty six pounds due to my son Charles from the estate of his late father and secured by his promissory note) and funeral expenses be fully paid and discharged and subject thereunto. I give and bequeath my moiety or half part of the farming stock both live and dead implements of husbandry and other farming effects at Chedworth unto my son Charles In trust for my three grandchildren (the children of my deceased son William) and if either of them should die under the age of twenty one years without having lawful issue his or her share to go to the survivors or survivor. The other half part of such farming stock and effects being the property of my said son Charles. I give and devise all those my cottages and lands situate in South Cerney in the County of Gloucester in the respective occupations of John POLLARD and ……… RIGSBY with their several appurtenances unto my son Charles his heirs and assigns subject and charged nevertheless with the payment of the mortgage debt or debts due or secured thereon and I expressly exonerate my said personal estate from the payment of such mortgage debt and debts or any part thereof. And as to all that messuage or tenement with the appurtenances and all and every the several closes pieces and parcels of arable meadow and pasture land hereditaments and premises with the appurtenance thereunto belonging called by the name of Four Mile House situate in Duntisborne Abbots in the said County of Gloucester formerly in the occupation of John ABLE and now or late of Mrs. ANDREWS. And also as to that the estate lands and hereditaments and premises with their appurtenances situate at Winstone in the said County of Gloucester and Dutisborne aforesaid or elsewhere devised by the will of my late father Edward Painter HAVILAND deceased to my children by my late husband Robert SUTTON in such proportions as I should by my will in case I should survive my said husband direct I do therefore by this my will direct appoint give and devise the same several messuages lands hereditaments and premises with the appurtenances unto my three present only children (that is to say) Edward, James and Charles in equal shares and proportions and to their heirs and assigns as tenants in common. All my household goods and furniture and all singular other my real and personal estate and effects whatsoever and of what nature or kind soever I give devise and bequeath unto my said son Charles his heirs executors administrators and assigns absolutely and for ever. And I appoint my said son Charles executor of this my last will and testament hereby revoking all former and other wills by me at any time heretofore made and declaring this to be my last will and testament. In witness whereof I have hereunto set my hand and seal this fourth day of December one thousand eight hundred and fifty two.

Mary SUTTON died on or about 9 March 1853. The will was proved 4 February 1854 and it was sworn as being under £800 in value.
Robert and Mary SUTTON were tenants of Lord Eldon and lived at The Manor. Their son Charles continued the tenancy to at least 1881.
