1837 - The Will of Daniel Glover Woodward of Chedworth

In the name of God Amen. I Daniel GLOVER (else Wright) of the Parish of Chedworth in the County of Gloucester, Woodward, being of perfect mind and memory thanks be to God for it, and knowing that it is appointed for all men once to die do make and ordain this my last will and testament in the followinf manner and form.
First I give to my Daughter in Law Esther GLOVER, widow of my son John GLOVER (else Wright) all the cottage, garden, orchards and premises I now reside at situate near Cheap Street in the Parish of Chedworth aforesaid (so long as she remains a widow). I give it to her the said Ester GLOVER for her natural life but if she should marry or die then I give it to my grandson Daniel MASSEY when of the age of twenty one years. I give it to him and his heirs for ever but if I die before he is of age and my Daughter in Law is dead then I leave it to the care of trustees whom I shall hereafter appoint until he is of the age of twenty one.
NB There is one shilling a year chief rent to be paid to Hutnash out of the above premises.
I also give to my aforesaid Daughter in Law the use of any part of my furniture as long as she remains possessed of the above premises with the use of the cyder mill press and all things belonging and when she has done with it I wish it to be divided between my three Grand Children, Mary MASSEY, Elizabeth MASSEY and Daniel MASSEY in equal shares by my trustees. I wish Daniel MASSEY to have my best clock with the cyder mill, press etc. in part of his share.
NB If it should prove that I have no right to give the aforesaid premises to my Daughter in Law for her life then I will that my Grandson Daniel MASSEY or my Trustees shall pay her the sum of seven pounds a year out of his share so long as she can claim right to it as before stated.
Secondly I give and bequeath unto my Grandson Daniel MASSEY and his heirs for ever all that cottage and garden with all the appartenances thereto belonging and now in the occupation of Thomas MASON Senior. I also give him the said Daniel MASSEY the pasture ground, orchard, barn, stables and all the premises thereto belonging called Smugs Barn with all fences water etc. Also I give and bequeath unto him the said Daniel MASSEY all my two inclosures of arable land called Stoney Furlong all in the Parish of Chedworth aforesaid about eight acres and a half be the same more or less, part belonging to Smugs Barn and part I bought of Robert ROBBINS. All the above premises I give to my Grandson Daniel MASSEY when he has attained the age of twenty one. I give to him and his heirs for ever, but if I should die before he has attained that age then I leave it to the care of trustees whom I shall appoint to receive the rents and profits of the aforesaid premises and divide the money as shall hereafter be directed when Daniel MASSEY is of the age of twenty one years. If my grandson Daniel MASSEY should die before he has attained the age of twenty one or come into possession of the above property then I give all the above property to my two Granddaughers Mary MASSEY and Elizabeth MASSEY and their heirs for ever to be equally divided between them by my trustees, and if Daniel MASSEY should die before he is twenty one then I give the premises I now live in to my two Granddaughters Mary and Elizabeth MASSEY I give it to them and their heirs for ever when my Daughter in Law has done with it. And when my Daughter in Law Ester GLOVER has done with the premises I have allotted her and my Grandson Daniel MASSEY have possession of all the estates I have allotted for him then I will that he pay to his two sisters (if they are living) Mary MASSEY and Elizabeth MASSEY the sum of fifty pounds each of good and lawful money within one year after the aforesaid Ester GLOVER deceased out of the above estate and effects.
Thirdly I give and bequeath unto my Granddaughter Mary MASSEY all that cottage, gardens and premises I bought of my cuzon John GLOVER (else Wright) and all appurtenences thereto belonging. I give it all to the aforesaid Mary MASSEY to her heirs for ever with a right of water at my draw well she paying her share of the expenses in repairing the said draw well when necessary to be done, the aforesaid cottage and gardens are now in the occupation of James SMITH and myself I will that she have a right to enjoy it from the next Quarter Day after my decease but if she should die before me (single) then I give all the above to my Granddaughter Elizabeth MASSEY to her and her heirs for ever when she attain the age of twenty one years and if she should die before she comes into possession of it then I give it to my Grandson Daniel MASSEY to him and his heirs for ever all the abofe mentioned cottage gardens etc. I give to him when he attains the age of twenty one years.
NB The above premises are situate by the Cirencester Road in Chedworth.
Fourthly I give and bequeath to my Granddaughter Elizabeth MASSEY all the cottage, garden and all appurtenances thereto belonging called Roberts which I purchased of Emanuel BRIDGES, all the above premises I give unto my Granddaughter Elizabeth MASSEY aforesaid to her and her heirs for ever, they are situate in Cheap Street in the parish of Chedworth aforesaid. She is to possess it when she attains the age of twenty one years but if she should die before she is of that age then I give the aforesaid premises all of it to my Granddaughter Mary MASSEY to her and her heirs for ever, and if she should die bewfore she is possessed of it then I give it to my Grandson Daniel MASSEY, I give it to him and his heirs for ever, to be left to the care of my trustees during their minority.
Fifthly I give and bequeath unto my Son in Law William MASSEY the sum of one pound to be paid out of my estate and effectsby my trustees.
I wish my farming stock, such as cattle, corn, hay and all kind of implements thereto belonging to be valued or sold and the amount of the sum with all the money arising out of my estate and effects until Daniel MASSEY is of the age of twenty one years be put to interest (after paying all debts that may be due) and when the said Daniel MASSEY is of age then I will that all moneys arising out of my estate and effects as aforesaid (after paying all funeral, administration and legacy duties with all other debts that may be due on my account) be divided into four equal parts that is to say my three Grandchildren to have three shares (if they are living) and my Daughter in Law Ester GLOVER to have the interest of her share for her life and after her death that one share to be equally divided between my three Grandchildren viz Mary MASSEY, Elizabeth MASSEY and Daniel MASSEY and if either of my Grandchildren should be in distress for want of food before before they come into their property that then they shall be relieved out of my property by my trustees.
Now I nominate constitute and appoint John BROAD Senior Land Surveyor and Thomas SMITH Innholder (both of Chedworth) or their heirs administrators or assigns to be my executors, trustees and guardians of this my last will and testament and I do hereby invest in them full power and authority to execute, receive and discharge the aforesaid legacies and all things contained herein and to pay themselves for their trouble and I do hereby revoke and disclaim all former will or wills made by me confirming this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this twenty first day of September one thousand eight hundred and thirty seven.

Notes by M. Tovey

Daniel GLOVER died on 26th of July 1840. The will was proved on 11th December 1840 and was sworn to be under £1000 in value.

Esther GLOVER (nee Sly) married John Glover in 1823. Esther died aged 69 and was buried at St. Andrews, Chedworth on 8 August 1846. Daniel MASSEY married Sarah Ann TROTMAN (daughter of William) at Chedworth on 27 March 1842. Frederick BARTLETT (a cordwainer) married Mary MASSEY at Chedworth on 30 March 1842. Thomas SIMPER (a gamekeeper) married Elizabeth MASSEY at Chedworth on 20 October 1845.

In 1843 Thomas MASON lived in the house now called Ansteys in Middle Chedworth.and it was owned by Elizabeth MASSEY.
